Standard Contract Between Fan and Creator

Last updated October 2026

This Standard Contract Between Fan and Creator (this "Contract") sets out the terms that apply between a Fan and a Creator each time they enter into a Creator Interaction on PlayHouse. Please read it carefully. Key points:

  • Subscriptions renew automatically. When you subscribe, your card is charged again at the end of each period until you cancel.
  • The contract is between the Fan and the Creator. Vallara, Inc., which operates PlayHouse, is not a party to it, but it processes payments and applies the Terms of Service.
  • Refunds go to your Wallet. Where a refund is given, it is credited to the Fan's PlayHouse Wallet, unless the law requires a refund to the original payment method, in which case the Fan may choose that instead.
  • Creators may have help. A Creator may be assisted by an Agency verified and approved by PlayHouse, whose team members may post and reply to messages on the Creator's behalf. PlayHouse shows when a Creator's account is managed with an Agency's help.
  • Your legal rights are protected. Nothing in this Contract takes away rights you have under consumer protection laws that cannot be excluded.

  19. General

1. Introduction and scope

  1. This Contract governs every Creator Interaction. It applies automatically each time a Creator Interaction is started on PlayHouse, and it applies instead of any other terms the Fan or the Creator may propose.
  2. This Contract sits alongside our Terms of Service and Acceptable Use Policy, which apply to both the Fan and the Creator in their relationship with Vallara.

2. Parties

  1. The only parties to this Contract are the Fan and the Creator taking part in the Creator Interaction.
  2. Vallara, Inc. ("Vallara," "we," "us"), a Delaware corporation that owns and operates PlayHouse, is not a party to this Contract and does not grant any rights in Content. Vallara processes Payments as described in section 4, and may take the steps this Contract and the Terms of Service describe, such as removing Content, giving refunds and suspending accounts.

3. Definitions

In this Contract, "Agency", "Agency share", "Content", "Creator", "Creator Interaction", "Fan", "Offer", "Payment", "platform fee", "Subscription", "User" and "Wallet", and other capitalized words not defined here, have the meanings given in the Terms of Service. In particular:

  • "Creator Interaction" means any interaction on PlayHouse that gives a Fan access to a Creator's Content or time, or that involves a payment to a Creator, including a Subscription, an Unlock, a paid message, a paid story, a tip, a purchase of VIP credits, a Livestream Ticket, a Video Call, and a Video Request or Custom Order.
  • "Payment" means any payment a Fan makes for a Creator Interaction, whether by card or from the Fan's Wallet, including a tip.
  • The "platform fee" is the fee Creators pay us under the Terms of Service: a 15% platform fee, unless a different rate has been agreed with a particular Creator or a promotion lowers it.
  • "Relevant Content" means the Content of a Creator to which a Creator Interaction relates.

4. Prices, payment and tax

  1. The Creator sets the price of each Creator Interaction. The Fan agrees to pay the price shown at the time of purchase. Prices are in US dollars.
  2. Prices exclude taxes. Where Vallara is required to collect value added tax, goods and services tax or sales tax on a Payment, it adds the tax and shows it before you pay.
  3. Subscriptions are paid by card. Other Creator Interactions are paid from the Fan's Wallet, which the Fan can top up by card.
  4. Before a Fan can see sensitive or paid Content, including media in messages, or subscribe, unlock paid Content, buy VIP credits or a Livestream Ticket, or join a livestream, the Fan must pass PlayHouse's age assurance.
  5. No one may buy from, tip or subscribe to their own account.
  6. The Creator appoints Vallara as the Creator's limited payment-collection agent to receive each Payment from the Fan on the Creator's behalf. When the Fan pays Vallara for a Creator Interaction, the Fan has paid the Creator for it. The Fan and the Creator authorize Vallara to collect any tax, to deduct the platform fee and any Agency share the Creator has agreed, and to pay the Creator's earnings to the Creator, all as set out in the Terms of Service. The platform fee, the Creator's earnings and any Agency share are recorded as separate transactions. Referral payments under our Referral Program Terms are paid by PlayHouse and are not deducted from the Creator's earnings.

5. Subscriptions and automatic renewal

  1. A Creator may offer one Subscription plan for each available duration, and may offer a plan at a sale price.
  2. When you select Subscribe, you start a Subscription that renews automatically at the end of each period. You authorize us to charge your card the renewal price, plus any applicable tax, at the start of each new period until you cancel. By selecting Subscribe, you acknowledge that you may not receive further notice before your Subscription renews, except where the law where you live requires it.
  3. If a Creator later changes the price of a plan, you keep the price you subscribed at for renewals of that Subscription.
  4. If a renewal payment fails, we try the other cards saved to your account. If no payment succeeds, your Subscription ends at the renewal date and we email you. We may retry the payment later, and if a retry succeeds, your Subscription renews.
  5. You can cancel a Subscription online at any time from your subscriptions list at /my-subscriptions. Your access continues until the end of the period you have already paid for. You will not receive a refund for the rest of a period you have paid for, except where the law requires one.
  6. A Subscription gives you access to the Content the Creator makes available to subscribers while your Subscription is active. Pay-to-unlock posts, paid messages and other separately priced Content are not included and must be paid for separately, including by subscribers.

6. Subscription offers

  1. A Creator may offer a free trial for the period shown (such as 7, 14 or 30 days), or an introductory price for a set number of periods, to new subscribers or to returning subscribers whose Subscription has lapsed, as the offer states. A Creator may share an offer through an offer link.
  2. When the free trial or introductory period ends, your Subscription continues automatically and we charge your card the regular price shown when you accepted the offer, plus any applicable tax, unless you cancel before the offer ends.

7. Unlocks, paid messages and stories

  1. Pay-to-unlock posts ("Unlocks"). A Creator may lock a post behind a one-time price. Everyone pays that price to unlock it, including subscribers. Once you unlock a post, you can view it on PlayHouse for as long as the license in section 12 continues.
  2. Paid messages. A Creator may send Content in a message, including a mass message, that you can unlock for the price shown.
  3. Stories. Stories are available for 24 hours. A Creator may make a story available to everyone, to subscribers only, or for a price. Access to a paid story ends when the story expires.
  4. Reels are free to view.

8. Tips and VIP credits

  1. Tips. A tip is a voluntary payment to a Creator. A tip does not entitle the Fan to any Content or service, unless the Creator clearly stated what a tip would get before the Fan tipped, for example in a tip request. If a Creator asks for a tip in return for something specific, the Creator must provide it.
  2. VIP credits. A Creator may sell bundles of VIP message credits, which let a Fan message the Creator, including when the Creator limits who can message them. Credits can be used only with the Creator who sold them and only as described when you buy them. Credits are not money: they cannot be transferred, exchanged or withdrawn.

9. Livestreams

  1. A Creator may hold livestreams that are free or require a ticket ("Livestream Ticket"). A Livestream Ticket gives access to that live broadcast only. Subscribers also need a Livestream Ticket for a ticketed livestream.
  2. PlayHouse does not record livestreams, so they cannot be replayed. Fans may tip during a livestream.
  3. Neither the Fan nor the Creator may record a livestream. PlayHouse may stop a livestream that breaks the Terms of Service or the Acceptable Use Policy.
  4. If a ticketed livestream does not take place, the Fan may contact us through our contact form, and we may refund the ticket to the Fan's Wallet.

10. Video calls

  1. A Fan may book a video call ("Video Call") with a Creator for the length and price shown, at a time the Creator makes available.
  2. The Creator is paid for a Video Call only if both the Fan and the Creator were in the call for at least 80% of the booked time. Otherwise, the Fan is refunded in full to their Wallet.
  3. PlayHouse does not record Video Calls. Neither the Fan nor the Creator may record a Video Call. Everything said and shown in a Video Call must comply with the Acceptable Use Policy, and PlayHouse may end a call that does not.

11. Video requests and custom orders

  1. Where a Creator has turned on video requests and set a price, a Fan may ask the Creator for a personalized video or other custom Content (a "Video Request" or "Custom Order"). The Creator decides whether to accept it.
  2. A Creator must decline any request that would break the Acceptable Use Policy. A Fan must not ask for prohibited Content, and doing so may lead to action against the Fan's account.
  3. Once the Creator accepts and the Fan pays, the Creator must deliver, through PlayHouse, Content that matches what was agreed. Delivered Content goes through the same safety checks as other uploads.
  4. If the Creator does not deliver, or the Content delivered does not match what was agreed, the Fan may contact us through our contact form, and we may refund the Fan's Wallet.

12. License of Content

  1. When a Fan pays for a Creator Interaction (or, for free Content, when the Creator makes it available), the Creator grants the Fan a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable license to view the Relevant Content on PlayHouse, in a web browser or the PlayHouse web app, for the Fan's own non-commercial use, in line with the Acceptable Use Policy.
  2. The license allows only the temporary copies a browser makes automatically to display Content. It does not allow downloading, recording, screenshotting, copying or sharing.
  3. The Creator keeps all ownership rights in the Relevant Content. The Fan does not acquire any rights in it other than this license.

13. When the license ends

The license ends automatically, without notice:

  1. if the Payment fails, is charged back or is reversed;
  2. for a Subscription, when the paid period ends without renewal;
  3. for a paid story, when the story expires;
  4. if the Creator removes the Relevant Content or deletes their account;
  5. if PlayHouse removes the Relevant Content, or suspends or closes the Creator's account;
  6. if the Fan's account is suspended or closed;
  7. if the Fan breaches the Terms of Service or the Acceptable Use Policy; or
  8. if the Fan closes their account.

14. Cancellation and refunds

  1. If there is a problem with a Creator Interaction, the Fan should contact us through our contact form. We may decide to give a refund under the Terms of Service. Refunds are credited to the Fan's Wallet by default. Where the law requires a refund to the original payment method, the Fan may choose that instead.
  2. Content being removed does not by itself entitle the Fan to a refund.
  3. When a Payment is refunded or charged back, the amount is recovered from the Creator's earnings (and from any Agency share), as the Terms of Service describe.
  4. If you are a consumer in the European Union, the European Economic Area or the United Kingdom, you would normally have 14 days to withdraw from a contract for digital content. Each time you start a Creator Interaction, you confirm at checkout that you accept the Terms of Service. By doing so, you expressly ask for access to begin immediately and you acknowledge that, once it has begun, you lose that right of withdrawal to the extent the law allows.
  5. Nothing in this Contract affects any right to a refund or other remedy that a Fan has under consumer protection laws that cannot be excluded.
  6. A Fan agrees not to start a chargeback unless they dispute the Creator Interaction in good faith, and to contact us first. A chargeback suspends the Fan's account.

15. What Fans and Creators promise each other

The Creator promises that:

  1. they own, or have all the rights and permissions needed to license, the Relevant Content in the places where Fans will view it;
  2. the Relevant Content complies with the Terms of Service, the Acceptable Use Policy and the law, and everyone who appears in it was an adult when it was created and consented to being recorded and to its publication and, where the Content is sexually explicit or contains nudity, is a verified PlayHouse Creator tagged by @username or has completed PlayHouse's co-performer release form (see Content featuring other people);
  3. they will describe paid Content and services accurately and make paid Content available once the Fan has paid; and
  4. they are solely responsible for creating and uploading the Relevant Content.

The Fan promises that:

  1. they will pay for each Creator Interaction they start;
  2. they will comply with the Terms of Service and the Acceptable Use Policy, including by not recording, copying or sharing the Relevant Content and not asking for prohibited Content; and
  3. they understand that they view the Relevant Content at their own risk, unless the Creator has been negligent or otherwise breached a duty to the Fan.

Both the Fan and the Creator agree to treat each other with respect and to keep their dealings on PlayHouse.

16. Agencies and help with Creator accounts

  1. The Fan acknowledges that a Creator may be assisted in running their account by an Agency verified and approved by PlayHouse and the Agency's team members. With the Creator's permission, they may post Content, manage Subscription plans and offers, and write and reply to messages on the Creator's behalf.
  2. PlayHouse shows a label on the profile and in the chats of a Creator whose account is managed with an Agency's help, so the Fan can see when that is the case.
  3. Agency team members must never claim to be the Creator personally when a Fan asks them directly.
  4. The Creator remains the party to this Contract and is responsible for everything done in their account, including by an Agency.
  5. No one may use an AI chatbot or any other automated tool to write chats or messages to Fans, as the Acceptable Use Policy explains.

17. No guarantees

  1. Creators decide what Content to make available and may add or remove Content, including pay-to-unlock Content, at any time. A Creator does not promise to keep creating or uploading Content.
  2. There may be times when a Fan cannot access Relevant Content, for example if the Creator's or the Fan's account is suspended or closed, if PlayHouse removes Content, or if all or part of PlayHouse is unavailable.

18. Disputes between Fans and Creators

  1. If a Fan and a Creator disagree about a Creator Interaction, they should first try to resolve it between themselves on PlayHouse. Either of them may ask us for help through our contact form. We may, but do not have to, help resolve the disagreement.
  2. This Contract is governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. If the Fan is a consumer, the Fan also keeps the protection of any mandatory laws of the place where the Fan lives.
  3. A claim under this Contract may be brought in the state courts located in Delaware, or in a small-claims court that has jurisdiction. A Fan who is a consumer in the European Union, the European Economic Area, the United Kingdom, Australia or another place whose law gives consumers that right may also bring a claim in the courts where the Fan lives.
  4. Any dispute between a User and Vallara is governed by the dispute resolution terms in the Terms of Service, not by this section.

19. General

  1. If any part of this Contract is found invalid or unenforceable, the rest of it remains in effect.
  2. Vallara may update this standard Contract. An updated version applies to Creator Interactions started after it takes effect and, for a Subscription, from the next renewal after it takes effect.
