Agency Terms
Last updated October 2026
These Agency Terms apply to any business that registers as an Agency on PlayHouse, and to everyone who works in PlayHouse for that Agency. Please read them carefully. Key points:
- An Agency account stays inactive until we have verified the business and approved it. Everyone who signs in to an Agency account must use an authenticator app.
- The Creator remains the account holder. An Agency works only on a Creator's work, never on the Creator's personal settings, and the Creator stays personally responsible for their account.
- An Agency must never take a Creator's sign-in codes, identity documents or payouts, or pressure anyone to create Content. An Agency withdraws only its own Agency share, never any part of a Creator's earnings.
- Fans are told when an Agency helps. PlayHouse shows when a Creator's account is managed with an Agency's help, and Team Members must never claim to be the Creator personally when a Fan asks directly.
- Breaking these terms can lead to loss of access, withheld or forfeited earnings and termination.

1. About these terms
- These Agency Terms are part of the Terms of Service between the Agency and Vallara, Inc. ("Vallara," "we," "us"), the Delaware corporation that operates PlayHouse. The Terms of Service and the Acceptable Use Policy apply to the Agency, its owners and its team members. If these Agency Terms conflict with the rest of the Terms of Service on a matter about Agencies, these Agency Terms apply.
- If the Agency is established in the European Union, the European Economic Area or the United Kingdom, our Platform-to-Business Terms may also apply. If the Agency takes part in our referral program, our Referral Program Terms apply too.
- The person who registers the Agency confirms that they are at least 18 and are authorized to accept these terms for the Agency.
2. Definitions
- "Agency" (also "you"): a business, such as a company, partnership or sole trader, that has registered an Agency account on PlayHouse.
- "Agency Owner": the individual who registered or controls the Agency account.
- "Agency share": the Agency's commission, being the percentage of Payments to a Linked Creator that the Agency and the Creator have agreed, as described in section 9.
- "Creator Work": the parts of a Linked Creator's account an Agency may work in, listed in section 5.
- "Linked Creator": a Creator who has linked their account with the Agency, for as long as the link lasts.
- "Personal Settings": the parts of a Creator's account that stay with the Creator, listed in section 6.
- "Team Member": an individual the Agency adds to its Agency account to work for it on PlayHouse.
Other capitalized words have the meanings given in the Terms of Service.
3. Becoming an Agency
- To become an Agency, you must register an Agency account and give us the information we ask for, including details of the business, its owners and how it works with Creators.
- We verify every Agency. Before we approve an Agency, we carry out business verification, which checks that the business exists and that the details you give us about it and its owners are accurate, and identity verification of the Agency Owner. We may ask for further documents and repeat these checks at any time.
- An Agency account is inactive until we have verified and approved it. We decide whether to approve an Agency, and we may refuse or withdraw approval, including where we cannot verify information or have concerns about the safety of Creators or Fans.
- You must keep your information accurate and up to date, and give us further information when we ask for it.
- Approval does not mean PlayHouse endorses, recommends or partners with your Agency. You must not say or suggest that it does.
4. Linking with a Creator
- A Creator may choose to link their account with an approved Agency. Linking is always the Creator's free choice.
- Before working with a Creator on PlayHouse, the Agency must have a clear agreement with the Creator, in writing, that covers the services the Agency provides, the Agency share and how either of them can end the arrangement, and must give the Creator a copy. PlayHouse is not a party to that agreement.
- Nothing in any agreement between an Agency and a Creator can stop the Creator from ending the link on PlayHouse, keeping control of their account, or receiving the earnings the Terms of Service give them.
- The Creator may end the link at any time, by unlinking in their account or by contacting us through our contact form. The Agency may also end the link, and we may end it under section 16.
- When a link ends, the Agency's access to the Creator's account ends, and the Agency share stops applying to Payments made after the link ends.
- Changing the Agency share. To change the agreed Agency share, the Creator or the Agency can ask us through our contact form. Our staff confirm the new rate with the Creator before applying it. The new rate applies to Payments made after it is applied.
5. What an Agency may do
With the Linked Creator's permission, an Agency and its Team Members may work in the Linked Creator's account through PlayHouse's agency tools on the Creator's work only. Creator Work means:
- chat and messages;
- the composer and posts;
- Subscription plans and offers;
- subscribers and lists;
- auto-messages;
- insights;
- livestreams;
- orders, including video requests and custom orders; and
- call hours for video calls.
All Creator Work must comply with the Terms of Service, the Acceptable Use Policy and these Agency Terms.
6. What an Agency may not do
- Personal Settings stay with the Creator. A Creator's security settings (including sign-in and any authenticator app), notification settings, blocked list, email address, payout details and identity verification belong to the Creator alone. An Agency must not access, change or try to control them.
- No credentials. An Agency must never ask for, hold or use a Creator's sign-in codes, backup codes or email account, or sign in as the Creator. Agencies work in Creator accounts only through PlayHouse's agency tools.
- No control of payouts. An Agency must never ask a Creator to have their earnings paid to an account the Creator does not own, take control of a Creator's payout details, or receive any part of a Creator's earnings through PlayHouse other than the Agency share.
- No identity substitution. An Agency must not complete identity or age verification for a Creator, supply anyone else's identity document, face or card, or help anyone get around verification.
- Only approved Content. An Agency may publish only Content that the Linked Creator has provided and approved for publication. An Agency must not create or alter Content of a Creator with AI, except AI-altered Content of the Creator that the Creator has approved and that is labeled with #ai as the Acceptable Use Policy requires.
- No automation. An Agency must not use AI chatbots, scripts, bots or other automated tools to operate a Creator's account or to reply to Fans, other than the messaging tools PlayHouse provides.
- No self-dealing. An Agency, its owners and its Team Members must not buy from, tip or subscribe to a Linked Creator, fund other people to do so, or create fake engagement to increase a Creator's earnings, ranking or any bounty.
- Nothing outside the Creator's work. An Agency must not use its access to a Linked Creator's account for any purpose other than the Creator's work on PlayHouse.
7. The Creator stays responsible
- The Linked Creator remains the account holder and the party to every Standard Contract Between Fan and Creator made through their account.
- The Linked Creator remains personally responsible to us for everything done in their account, including anything the Agency or its Team Members do.
- The Agency is also responsible to us for everything it and its Team Members do on PlayHouse.
8. Dealing with Fans
- Disclosure to Fans. Fans are told, in the Standard Contract Between Fan and Creator, that a Creator may be assisted by an Agency whose Team Members may help run the Creator's account and write and reply to messages on the Creator's behalf. PlayHouse also shows a label on the profile and in the chats of every Linked Creator. An Agency must not hide, remove or work around that label.
- Never claim to be the Creator. A Team Member must never claim to be the Creator personally when a Fan asks directly whether they are talking to the Creator.
- When writing to Fans for a Creator, an Agency must not deceive Fans. In particular, it must not make promises the Creator has not agreed to (such as Content, calls or meetings), pressure Fans to spend, or take advantage of a Fan who appears to be vulnerable or in distress.
- An Agency must not arrange or suggest in-person meetings, ask Fans to pay or communicate outside PlayHouse, or share contact or payment details, as the Acceptable Use Policy prohibits.
- If an Agency sees anything suggesting that a Fan may be under 18, or that anyone is at risk of harm, it must report it to us promptly using the Report action or our contact form.
9. The Agency share
- The Agency share is the percentage of each Payment to a Linked Creator that the Agency and that Creator have agreed and that is recorded in PlayHouse. It can differ for each Creator. The rate on the current accepted link applies to each sale.
- The Agency share is taken from the same gross amount as the platform fee. The platform fee and the Agency share together can never exceed the price of the Creator Interaction. We may set a maximum Agency share.
- The platform fee, the Creator's earnings and the Agency share on each Payment are recorded as separate transactions. The Agency share applies only to Payments made while the link is active, and is credited to the Agency's wallet. The Creator's earnings are credited to the Creator's own Wallet, and the Agency can never withdraw or receive any part of them.
- If a Payment is refunded or charged back, we recover the Agency share for that payment from the Agency's earnings, in the same way as we recover the Creator's portion from the Creator. We may set off amounts the Agency owes us against the Agency's balance and later earnings.
10. Agency wallet and payouts
- An Agency has a wallet that shows its Agency share and any bounty awards. An Agency can withdraw only the earnings in its own wallet.
- Agency payouts follow the same payout rules as Creator payouts in the Terms of Service. Payouts are made by bank transfer to a bank account the Agency saves, in the name of the Agency or the Agency Owner. The details we need vary by country. Payouts are made in the currency of the bank account or in US dollars.
- Business verification and identity verification of the Agency Owner must be completed before any payout, and we may ask for further information to verify the Agency Owner and the business. Payouts are reviewed and approved by our staff.
- Earnings may be held for a period before they can be withdrawn. Your wallet shows what is pending and what you can withdraw now; the hold that applies depends on your account's payout history. Any withdrawal fee is shown before you confirm.
- We may withhold, or treat as forfeited, all or part of an Agency's earnings in the same circumstances as the Terms of Service allow for Creator earnings, including while we investigate a suspected breach, fraud, refund or chargeback.
11. Agency bounties
- From time to time, PlayHouse may offer a bounty: a set amount paid to an Agency for each Creator who links with it during a stated window and reaches a qualifying amount of earnings within a set number of days. We decide whether to offer a bounty and set its amount and conditions, which we will tell you when we offer it. Conditions may include that qualifying earnings come from Fans who are not connected with the Agency.
- Each award is approved by PlayHouse staff before it is paid. An Agency has no right to a bounty until we approve the award. Once paid to the Agency's wallet, an award is treated as Agency earnings under section 10.
- No bounty is earned for a Creator who is owned, controlled or operated by the Agency, its owners or its Team Members, or for earnings created by self-dealing or fake engagement. We may refuse, reverse or recover an award obtained through a breach of these terms or fraud.
- Bounties are discretionary. We may change, suspend or end any bounty at any time. Ending a bounty does not affect awards we have already approved, unless they were obtained through a breach or fraud.
12. Team members
- An Agency may add Team Members to its Agency account. Each Team Member must be at least 18 and must use their own PlayHouse sign-in. Team Members must never share their sign-in codes or access with anyone else.
- Authenticator app required. The Agency Owner and every Team Member must add an authenticator app to their PlayHouse sign-in before they can use the Agency account.
- Where the agency tools allow, an Agency may choose which Linked Creators and which areas of Creator Work each Team Member can access. The Agency should give each Team Member only the access they need.
- The Agency is responsible for its Team Members: it must make sure they understand and follow the Terms of Service, the Acceptable Use Policy and these Agency Terms, and must remove a Team Member's access promptly when they stop working for the Agency.
- We may remove a Team Member's access.
13. Compliance, safety and anti-trafficking
- An Agency must comply with all laws that apply to its business, including employment, anti-trafficking and anti-slavery, data protection, consumer protection, advertising, tax, anti-bribery and sanctions laws.
- No coercion. An Agency must never force, threaten, deceive or pressure anyone into creating Content, appearing in Content, performing, linking with the Agency or staying linked. It must never hold a Creator's identity documents, passport, phone or other devices; impose debts or penalties to keep a Creator working; withhold a Creator's earnings; or control where a Creator lives, works or travels.
- Adults who verify themselves. Every Linked Creator must be an adult who has completed PlayHouse's Creator verification themselves. An Agency must never recruit or work with anyone under 18.
- Honest recruitment. When recruiting Creators, an Agency must not make misleading claims, including about likely earnings or numbers of Fans, or suggest that PlayHouse endorses it.
- Report concerns. If an Agency becomes aware of signs of trafficking, coercion or exploitation, or that anyone involved may be under 18, it must report it to us promptly through our contact form and, where appropriate, to law enforcement. To learn more, see Preventing Modern Slavery and Human Trafficking and our Anti-Slavery and Anti-Trafficking Statement.
- Cooperation. An Agency must cooperate with any review we carry out, including by giving us copies of its agreements with Linked Creators and other information we reasonably ask for. We may contact a Linked Creator directly, without the Agency, to confirm that they are working with the Agency freely.
14. Data protection and confidentiality
- When working in a Linked Creator's account, an Agency and its Team Members can see personal data about the Creator and about Fans, such as messages, usernames, purchases and insights. The Agency is responsible for how it and its Team Members handle that data, and for complying with the data protection laws that apply to it.
- An Agency may use personal data it sees on PlayHouse only to provide its services to the Linked Creator on PlayHouse. It must not copy, export, download or scrape that data; build lists of Fans; contact Fans outside PlayHouse; sell or share the data; or use it to train AI.
- An Agency must keep that data confidential, let only Team Members who need it see it, and protect it with appropriate security measures.
- If an Agency becomes aware of any unauthorized access to a PlayHouse account it works in, or to personal data it has seen on PlayHouse, it must tell us promptly through our legal request form. Security vulnerabilities in PlayHouse should be reported as our Vulnerability Disclosure Policy describes.
- When a link ends, or the Agency stops using PlayHouse, the Agency must delete any copies of PlayHouse personal data it holds about that Creator or their Fans, unless the law requires it to keep them.
- We process personal data about the Agency, its owners and its Team Members as described in our Privacy Policy.
15. Tax
The Agency is responsible for reporting and paying any taxes on its Agency share, bounty awards and other earnings. We may ask for tax information and documents, such as tax forms and tax identification numbers, report the Agency's earnings to tax authorities as the law requires (for example, on US Form 1099 or under the EU's DAC7 rules), and withhold tax from payouts where the law requires it. The tax terms in the Terms of Service also apply.
16. Suspension and termination
- An Agency may stop using PlayHouse at any time by ending its links with Creators and asking us to close its Agency account through our contact form.
- We may suspend an Agency account, remove its access to any Linked Creator, end any link, withhold earnings or close the Agency account, as the Terms of Service allow, including if we believe the Agency or a Team Member has breached these Agency Terms, the Terms of Service or the Acceptable Use Policy; if a Creator raises a concern we consider credible; while we investigate; to protect Creators, Fans or PlayHouse; or where the law requires. We may act immediately for serious breaches, such as anything involving coercion, minors, credentials or payouts.
- When an Agency account is closed, all links end, the Agency's access to Creator accounts ends, and the Agency share stops applying. Earnings already credited are paid out under the payout rules, subject to our rights to withhold, recover and set off amounts and to treat earnings as forfeited where the Terms of Service allow.
- Sections 6, 7, 9.4, 10.5, 13, 14, 17 and 18 continue to apply after an Agency account is closed.
17. Responsibility and indemnity
- PlayHouse is not a party to any agreement between an Agency and a Creator, and is not responsible for the Agency's services or conduct.
- The Agency will indemnify Vallara against claims, losses and costs arising from the acts or omissions of the Agency or its Team Members, from the Agency's breach of these Agency Terms, or from its agreements with Creators, to the extent the law allows.
- The limits of our liability in the Terms of Service apply to the Agency.
- These Agency Terms do not create any employment, partnership, joint venture or agency relationship between Vallara and the Agency. The Agency has no authority to act for or bind Vallara.
18. General
- The governing law and dispute resolution terms in the Terms of Service apply to these Agency Terms, including the terms that apply to Business Users.
- We may change these Agency Terms as the Terms of Service describe.
- An Agency may not transfer its Agency account or its rights under these terms without our written consent.
- For help, use our contact form. For legal inquiries, use our legal request form.
